TERMS AND CONDITION
1. Indian Travel Agent shall not be responsible and shall not accept any liability towards the holder himself or his/her legal representative for nay loss of property or damages resulting from death or injuries including loss of services which the holder may sustain on account of act negligence or default by any transportation Company, hotel agents or any other body of persons, its agents or service providing such services or facilities or arising out of or while engaged in any tour means of transportation or other services. Whether due to Ownership, maintenance, use operation or control of any automobile, bicycle, boat motor other vehicle in common carrier or otherwise and whether due to its or their negligence or otherwise and regardless of how caused. Holder using sporting equipment. Bicycles, sailing boats, scuba diving gear etc.
2. In no event shall Indian Travel Agent be responsible for any direct, indirect, special or consequential loss, injury and damage resulting from acts of God. Perils incident to the sea. Floods, fire, breakdown of machinery, acts of government or any other authorities, wars, civil disturbances, riots, theft, pilferage, epidemics, quarantines or any delays or change of schedule/itinerary or any such causes whatsoever including any liability or extra expenses sustained by the holder, Further, the holder shall be liable for the liability or extra expenses incurred by him/her as a result of the forgoing causes.
3. It is understood that Indian Travel Agent and its associates or agents act as agents only for all services covered hereby and that all tickets, coupons or exchange orders are furnished and issued subject to the terms and conditions thereof and to those under which the means of transportation or other services are supplied. The tickets, coupons or passage contract in use by any carrier/hotel or other contractor rendering services shall constitute the sole contract between the holder and such contractor.
4. Indian Travel Agent reserves the right to amend any aspect the itinerary including transportation and accommodation without notice for any reason whatsoever without making any rebate allowance refund and the extra cost, if any shall be payable by the holder hereof.
5. Indian Travel Agent reserves the right to cancel this exchange order in case it deems that the tour, trip or passage impracticable for any reason or should circumstances warrant such action, upon refunding the value thereof and the holder shall not have any other or further claim against the company by reason thereof.
6. All disputes arising in connection with this Agreement shall be referred to an Arbitrator to be appointed by Indian Travel Agent .All such disputes shall be subject to h jurisdiction of Delhi (India) Courts only. The laws of India shall govern the validity, interpretation, construction performance and enforcement of these terms and conditions.
7. Indian Travel Agent reserves the right to refuse to carry out its contract with any person whom if may consider to be undesirable in its absolute discretion and it shall not be required to show any reason for its so doing.
8. The laws of India shall govern the validity, interpretation construction performance and encodement of these terms and conditions.
